The terms and conditions below apply to all coaching and beauty services provided by Elizabeth de Bakker the (“Coach/Makeup Artist”), to any individual or organisation the (“Client”) and form the contract for the service to be provided by Elizabeth de Bakker for the Client.
The term ‘Coaching’ used here covers life coaching, personal coaching, business coaching, and personal development for clients.
The term ‘Makeup Artist’ used here covers makeup application, facials, false eyelash application, eyelash curling, using makeup brushes, and beauty lessons/tuition for clients.
In the spirit of good practice, when you are purchasing Coaching/Makeup Artist services from me I ask you to confirm that you have read and agreed to each statement below and that you wish to proceed.
All Coaching and Makeup Artist services and any related communication via email/tel or other forms of communicated, delivered by myself Elizabeth de Bakker, as well as information on this website www.delush.co.uk are meant to help you improve your mental and physical well-being. Coaching and/or makeup artistry services are not a substitute for professional mental health care or medical care.
In committing to Coaching/Makeup Artistry services with Elizabeth, you acknowledge the following:
You understand that coaching and/or makeup artistry services are not a substitute for psychotherapy, psychoanalysis, professional counselling, mental health care or substance abuse treatment, and you will not use it in place of any other form of professional therapy.
You understand that your Coach/Makeup Artist is not acting as a medical professional or mental health counsellor. You understand that the coaching and makeup artistry services that you will be receiving from Elizabeth are not offered as a substitute for professional medical care or mental health care and are not intended to diagnose or treat or cure any medical or mental health conditions.
You understand that coaching is currently an unregulated industry in England and that your coach is not legally licensed by any UK body even though the sessions may take place in England.
You understand and agree that you are fully responsible for your well-being during your coaching/makeup artistry sessions and following each session and any decisions made thereafter.
You understand that our work together involves coaching and beauty skills, and that your Coach/Makeup Artist is not guaranteeing results including but not limited to personal improvement and business profitability.
You understand that all insights, advice, ideas, suggestions, and comments made by your Coach/Makeup Artist are solely for the purpose of assisting you in achieving the predefined goals that you create with your Coach/Makeup Artist and understand that results are not guaranteed.
You understand that the use of technology is not always guaranteed to be secure and that you accept the risks of confidentiality in the use of phone, email, text, and any other technology.
You understand that your coach/makeup artist will protect the information provided by yourself as confidential unless you state otherwise. Your confidentiality agreement may be limited if you report that you threaten to harm yourself or others as a result of the personal issues that you are facing and seeking to resolve through coaching and beauty services.
You hereby release, waive, acquit and forever discharge your coach/makeup artist, any agents, successors, assigns, executors, personal representatives, heirs and employees from every claim, suit action, demand or right to compensation for damages you may claim to have or that you may have arising out of acts or omissions by yourself or by your Coach/Makeup Artist as a result of the advice and beauty services given by your Coach/Makeup Artist or otherwise resulting from the Coach/Makeup Artist relationship initiated by these terms and conditions.
You also further declare and represent that no promise, agreement, or inducement, not expressed in this agreement has been made to you to sign this agreement.
This agreement shall bind your executors, heirs, personal representatives, assigns, successors, and agents.
The Coach/Makeup Artist makes no warranties and shall not be liable for any direct and consequential damages arising out of the performance of services rendered.
While reasonable care is taken to ensure hygiene, the Coach/Makeup Artist will not be held accountable for any allergic reactions or any complications arising from any process of the makeup application (including receiving facials, having eyelashes curled, having eyebrows plucked or trimmed, using make-up brushes and having false eyelashes applied).
For coaching services the client must inform the Coach/Makeup Artist of any mental health issues PRIOR to the coaching sessions. The Coach/Makeup Artist may advise alternative treatment depending on the Client's conditions.
For makeup services the client must advise the Coach/Makeup Artist of any allergies PRIOR to the application (latex, ingredient allergies, etc.) The Client understands that she/he/they receives all makeup services at their own risk.
The Coach/Makeup Artist shall not be liable for omissions or failure to perform contracted services as a result of accident, inclement weather or events reasonably deemed beyond control of the coach/makeup artist.
Service packages are available for purchase via the website payment options.
The Client can book the services and then arrange with Elizabeth the date and time for the initial sessions.
Alternatively the Client can contact Elizabeth in advance to reserve a session date and time prior to purchasing. This will be held tentatively for x1 business day for payment in full to be made.
The Client must notify the Coach/Makeup Artist as soon as possible of requesting any additional services on the date.
The Coach/Makeup Artist reserves the right to refuse providing additional services which were not agreed to prior to the date of service.
For coaching/makeup artistry services, full payment in advance of the initial session or block of sessions is required. This can be made through the payment options found on the website. A date cannot be secured without payment in advance. After establishing a relationship between the coach/makeup artist a payment plan and method can be arranged for subsequent sessions.
For gift certificates a full payment must be made before the certificate can be issued.
Any additional services performed by the clients request, and if agreed to by Elizabeth, at the time the services are performed, will require payment within 3 business days.
If you do not arrive for your session or sessions the payments made are non-refundable and non-transferable.
For industry makeup services a quotation and/or day rate can be provided by email and services rendered then invoiced with payment terms of 30 days net.
Each service requires a certain length of time to be finished and is not to exceed the time limit due to Client delays either during or prior to the services. All persons involved in appointments need to be available at the scheduled time.
All services are provided in studio only. For bridal makeup applications an earlier time can be arranged for the bride and additional guests to arrive in studio.
Coaching services and beauty consultations are provided in studio in person or via Zoom if preferred.
Travelling to industry makeup locations is possible with travel expenses covered as part of the service.
For every 15 minutes of delay when a Client is late for the scheduled time, a late fee of £20.00 will be charged or if the scheduled service exceeds the allotted time because of the Client delays.
If the Client cancels within 48 hours of the scheduled time the booking payment is non-refundable.
Clients can contact Elizabeth at least 48 hours prior to the booking to re-schedule a new date and time.
Any advance payments made for services or gift certificates must be booked within 1 year otherwise the fee will be forfeited.
The Coach/Makeup Artist takes the client’s privacy seriously and will not share or discuss any details regarding your booking or your personal details with anyone not directly connected with your booking. All details collected are for the sole purpose of providing the best possible services to the client.
After the booking has concluded, the clients details will be kept securely for a maximum of three (3) years in accordance with GDPR requirements. The coach/makeup artist will never sell or share your information wtih a third-party.
The Coach/Makeup Artist may ask the client for permission to use photographs taken of the client on its website. These can include before and after photographs. The client can request at any time to remove any images used from the website.
Where our Site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources.
1. In the event the client fails to pay any payments due, the Coach/Makeup Artist may cease work without breach pending payment or resolution of dispute.
2. The Coach/Makeup Artist shall not be liable for any delay or non-performance due to circumstances beyond the Coach/Makeup Artist's control.
3. The Coach/Makeup Artist shall not be liable for any decisions made by the client resulting or associated with the services provided. Elizabeth has no liability for any loss incurred by any client, whether financial or otherwise following coaching and/or beauty services.
4. The Coach/Makeup Artist reserves the right to early termination of the services. If the Coach/Makeup Artist's personal circumstances result in sickness unavailability due to personal circumstances or if the client acts inappropriately or is threatening, offensive, or for other reasons the services may be terminated. Any advance payments made will be refunded.
5. The Coach/Makeup Artist is an independent service provider and not an employee of client.
6. Any changes to these terms must be agreed upon in writing by both the Coach/Makeup Artist and the Client prior to payment of the services by the Client.
These terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
